I. Right of withdrawal for service contracts

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date on which the contract was concluded. To exercise your right of withdrawal, you must notify us

by means of a clear statement (e.g. a letter sent by post or an email) informing us of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, although this is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send the notification of your exercise of the right of withdrawal before the withdrawal period expires.

Consequences of withdrawal

If you withdraw from this contract, we shall refund to you all payments we have received from you, including delivery costs (with the exception of any additional costs arising from your choice of a delivery method other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund. If you have requested that the services commence during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you notify us of your exercise of the right of withdrawal in respect of this contract, compared to the total scope of the services provided for in the contract.

Early expiry of the right of withdrawal

The right of withdrawal expires early upon full performance of the services

• in the case of contracts for the provision of services free of charge.
• in the case of contracts for the provision of services for a fee, provided that you have expressly agreed that the provision of services may commence before the expiry of the withdrawal period and you have received confirmation from us, on a durable medium, of your consent and your awareness of the premature expiry of the right of withdrawal.

II. Right of withdrawal in sales contracts

We may withhold the refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us without delay and, in any event, no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you post the goods before the end of the fourteen-day period. You shall bear the direct costs of returning the goods. You shall only be liable for any loss in value of the goods if this loss in value is attributable to handling the goods beyond what is necessary to ascertain their nature, characteristics and functioning.

Exclusion or early expiry of the right of withdrawal

The right of withdrawal does not apply to contracts

• for the supply of goods which are not prefabricated and for the manufacture of which an individual selection or specification by the consumer is decisive, or which are clearly tailored to the consumer’s personal needs;
• for the supply of goods which are liable to deteriorate rapidly or whose expiry date would be exceeded rapidly;
• for the supply of alcoholic beverages where the price was agreed at the time the contract was concluded, but which cannot be supplied until at least 30 days after the contract was concluded and whose current value depends on market fluctuations over which the trader has no control;
• for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts.

The right of withdrawal expires early in the case of contracts

• for the supply of sealed goods which, for reasons of health protection or hygiene, are not suitable for return if their seal has been broken after delivery;
• for the supply of goods where, due to their nature, they have become inseparably mixed with other goods after delivery;
• for the supply of audio or video recordings or computer software in sealed packaging, where the seal has been broken after delivery.
